Dustin Scoville entered a plea of not guilty to charges of child abuse resulting in death in Kearney County District Court on Wednesday.
The trial date was set for May 9 at 10:00 a.m. by Judge Stephen Illingworth. Scoville’s attorney Charles Brewster requested a jury trial.
Scoville, 23, is the fourth person charged in connection with the December 22, 2009 death of four-year-old Landon Payne. Also charged are Scoville’s ex-wife Katie Payne, Katie Payne’s mother Sharon Turnell and her husband, Charles Turnell.
Child abuse resulting in death is a Class 1B felony with a maximum sentence of life in prison.
The Wednesday morning hearing was a continuation of the January 12 arraignment hearing where a last minute filing of motions by Scoville’s attorney Charles Brewster resulted in a continuance of the arraignment hearing.
